In times of war, the representative of the State in the department may, by himself or by a special delegate, take a measure of communal interest by substituting himself for the mayor who, despite formal notice, has neglected or refused to take it.
When the measure to be taken is of inter-communal interest, the representative of the State in the department may substitute himself under the same conditions for the mayors of the communes concerned or, if the measure falls by its object within the remit of a public establishment for inter-communal cooperation, for the president of this establishment.
