In the event of a general mobilisation, when elections to the town council have been adjourned, the special delegation provided for in article L. 2121-35 is empowered to take the same decisions as the municipal council.

In times of war, the representative of the State in the department may, by himself or by a special delegate, take a measure of communal interest by substituting himself for the mayor who, despite formal notice, has neglected or refused to take it. The formal notice provided for in article L. 2124-3 must indicate the time limit given to the mayor or president of the public establishment for inter-communal cooperation to respond to the representative of the State in the department. Failure to respond within this timeframe is equivalent to a refusal.

In time of war, any member of a town council, including the mayor, may be suspended by decree on grounds of public order or the general interest until the cessation of hostilities. In wartime, in the event of the absence, suspension, dismissal or any other impediment of the mayor, the representative of the State in the department may appoint, to replace him in the fullness of his duties, a delegate chosen from among the members of the town council.

In time of war, the municipal council of a commune or the deliberative body of the public inter-municipal cooperation establishment may be suspended by decree, for reasons of public order or general interest, until the cessation of hostilities. The same decree constitutes a special delegation empowered to take the same decisions as the municipal council or the deliberative body of the public inter-municipal cooperation establishment.
