Article L2124-5 of the French General Code of Local Authorities

In time of war, any member of a town council, including the mayor, may be suspended by decree on grounds of public order or the general interest until the cessation of hostilities.

The elected representative thus suspended is not replaced numerically during the normal term of office of the assembly.

If the suspension measure has the effect of reducing the number of members of the assembly by at least one quarter, the decree ordering it constitutes a special delegation which is empowered to take the same decisions as the assembly.

En temps de guerre, tout membre d’un conseil municipal, y compris le maire, peut être suspendu par décret pour des motifs d’ordre public ou d’intérêt général jusqu’à la cessation des hostilités.

L’élu ainsi suspendu n’est pas remplacé numériquement pendant la durée normale du mandat de l’assemblée.

Si la mesure de suspension a pour effet de réduire d’un quart au moins le nombre des membres de l’assemblée, le décret l’ordonnant constitue une délégation spéciale qui est habilitée à prendre les mêmes décisions que l’assemblée.
