Article L2131-5 of the French Public Health Code

Unless otherwise provided, the terms and conditions for the application of this chapter shall be determined by decree in the Conseil d’Etat, and in particular :

1° The missions, the role of the other parties involved in prenatal diagnosis and the conditions for the creation and authorisation of the multidisciplinary centres for prenatal diagnosis provided for in Article L. 2131-1;

2° The nature of the medical biology tests intended to establish a prenatal diagnosis;

3° The conditions under which pre-implantation diagnosis may be carried out in an establishment specifically authorised for this purpose;

4° The conditions of establishment and operation that public health establishments and medical biology laboratories must meet in order to be authorised to carry out prenatal diagnosis activities.

Article L2131-5

Sauf disposition contraire, les modalités d’application du présent chapitre sont déterminées par décret en Conseil d’Etat et notamment :

1° Les missions, le rôle auprès des autres intervenants en matière de diagnostic prénatal et les conditions de création et d’autorisation des centres pluridisciplinaires de diagnostic prénatal prévus à l’article L. 2131-1 ;

2° La nature des examens de biologie médicale destinés à établir un diagnostic prénatal ;

3° Les conditions dans lesquelles le diagnostic préimplantatoire peut être réalisé dans un établissement spécifiquement autorisé à cet effet ;

4° Les conditions d’implantation et de fonctionnement que doivent remplir les établissements publics de santé et les laboratoires de biologie médicale pour être autorisés à exercer des activités de diagnostic prénatal.
