The powers devolved to the département by article L. 1423-1 and article L. 2111-2 are exercised, under the authority and responsibility of the president of the département council, by the departmental maternal and child protection service, which is a non-personalised service of the département. Doctors in maternal and child protection services work with health centres and health centres to implement the pathway referred to in 7° of article L. 6323-1-1 and in the last paragraph of article L. 6323-3. To this end, they may refer the child’s parents or legal representative to the health centres or health centres offering such a pathway.

All approved childminders must undergo training under the conditions set out in article L. 421-14 of the Code de l’Action Sociale et des Familles.

For the application of article L. 2111-2, the departmental services in charge of maternal and child protection may, in the event of a presumption that the childminder is taking in more children than authorised by the authorisation provided for in article L. 421-4 of the Code de l’action sociale et des familles, request the information necessary for them to carry out their duties from the body responsible for collecting social…
