Article L2135-1 of the French Public Health Code

In order to support children with neurodevelopmental disorders and make a diagnosis, an early assessment and intervention pathway is paid for by the health insurance scheme.

The pathway is organised by structures designated by order of the Director General of the Regional Health Agency from among the establishments or services mentioned in 2°, 3° and 11° of I of Article L. 312-1 of the Social Action and Family Code or the establishments mentioned in Article L. 3221-1 of this Code.

The healthcare professionals mentioned in articles L. 162-5 and L. 162-9 of the Social Security Code, articles L. 4331-1 and L. 4332-1 of this Code and psychologists may enter into a contract with the structures designated in the second paragraph of this article, in accordance with the standard contract defined by order of the ministers responsible for health, social security and disability. For each category of professional, this contract sets out commitments to good professional practice and the conditions for feedback to the designated structure and the attending doctor. In the case of the professionals mentioned in articles L. 4331-1 and L. 4332-1 and psychologists, the contract also sets out the terms and conditions under which the designated structure pays for the services provided as part of the care pathway.

Coverage under the pathway is subject to a medical prescription.

A decree in the Conseil d’Etat will set the conditions for the application of this article.

Pour l’accompagnement des enfants présentant un trouble du neuro-développement et pour la réalisation d’un diagnostic, un parcours de bilan et intervention précoce est pris en charge par l’assurance maladie.

Le parcours est organisé par des structures désignées par arrêté du directeur général de l’agence régionale de santé parmi les établissements ou services mentionnés aux 2°, 3° et 11° du I de l’article L. 312-1 du code de l’action sociale et des familles ou les établissements mentionnés à l’article L. 3221-1 du présent code.

Les professionnels de santé mentionnés aux articles L. 162-5 et L. 162-9 du code de la sécurité sociale, aux articles L. 4331-1 et L. 4332-1 du présent code et les psychologues peuvent conclure avec les structures désignées au deuxième alinéa du présent article un contrat, conforme au contrat type défini par arrêté des ministres chargés de la santé, de la sécurité sociale et du handicap. Ce contrat prévoit notamment, pour chaque catégorie de professionnels, des engagements de bonnes pratiques professionnelles et les conditions de retour d’information à la structure désignée et au médecin traitant. Pour les professionnels mentionnés aux articles L. 4331-1 et L. 4332-1 et les psychologues, le contrat prévoit également les modalités selon lesquelles la structure désignée rémunère les prestations réalisées dans le cadre du parcours.

La prise en charge du parcours est soumise à prescription médicale.

Un décret en Conseil d’Etat fixe les conditions d’application du présent article.
