Clinical activities involving medically assisted procreation, with the exception of artificial insemination and ovarian stimulation, may only be carried out in health establishments.

Subject to the following paragraph, the biological activities of medically assisted procreation may only be carried out in medical biology laboratories accredited in accordance with the provisions of Chapter I of Title II of Book II of Part Six.

The clinical and biological activities of medically assisted procreation relating to gametes for donation may only be carried out in public health organisations and establishments, or in private not-for-profit health organisations and establishments. Practitioners may not be remunerated on a fee-for-service basis for these activities.

With the exception of artificial insemination and ovarian stimulation, both clinical and biological activities in medically assisted procreation must be authorised in accordance with the provisions of Chapter II of Title II of Book I of Part VI of this Code.

To be authorised to carry out these activities, the establishments, laboratories and organisations mentioned in the first, second and third paragraphs and, where applicable, the health cooperation groups must use practitioners who can prove their competence and meet the conditions determined in application of the aforementioned provisions of part VI of this code and the operating conditions determined by regulation.

The authorisation covers one or more medically assisted procreation activities, with or without a third-party donor. It is issued for a period of seven years.

The implementation of in vitro fertilisation is subject to the combination of the clinical and biological authorisations mentioned in the fourth paragraph.

Les activités cliniques d’assistance médicale à la procréation, à l’exception de l’insémination artificielle et de la stimulation ovarienne, ne peuvent être pratiquées que dans des établissements de santé.

Sous réserve de l’alinéa suivant, les activités biologiques d’assistance médicale à la procréation ne peuvent être pratiquées que dans les laboratoires de biologie médicale accrédités selon les modalités prévues par les dispositions du chapitre Ier du titre II du livre II de la sixième partie.

Les activités cliniques et biologiques d’assistance médicale à la procréation relatives aux gamètes en vue de don ne peuvent être pratiquées que dans des organismes et établissements de santé publics, ou dans des organismes et établissements de santé privés à but non lucratif. Aucune rémunération à l’acte ne peut être perçue par les praticiens au titre de ces activités.

A l’exception de l’insémination artificielle et de la stimulation ovarienne, les activités, tant cliniques que biologiques, d’assistance médicale à la procréation doivent être autorisées suivant les modalités prévues par les dispositions du chapitre II du titre II du livre Ier de la partie VI du présent code.

Pour être autorisés à exercer ces activités, les établissements, les laboratoires et les organismes mentionnés aux premier, deuxième et troisième alinéas ainsi que, le cas échéant, les groupements de coopération sanitaire doivent faire appel à des praticiens en mesure de prouver leur compétence et remplir les conditions déterminées en application des dispositions susmentionnées de la partie VI du présent code et des conditions de fonctionnement déterminées par voie réglementaire.

L’autorisation porte sur une ou plusieurs des activités d’assistance médicale à la procréation, avec ou sans tiers donneur. Elle est délivrée pour une durée de sept ans.

La mise en oeuvre de la fécondation in vitro est subordonnée à la réunion des autorisations clinique et biologique mentionnées au quatrième alinéa.
