Article L2132-1 of the French Public Health Code

When a birth is registered, a health record is issued free of charge for each child. This booklet is issued by the civil registrar; failing this, it can be requested from the departmental maternal and child protection service.

A ministerial order shall determine the model and method of use of this booklet, which must include the results of the medical examinations provided for in articles L. 2132-2 and L. 2132-2-1 and in which all important observations concerning the child’s health must be noted as they occur.

The booklet is made out in the child’s name. It is given to the parents or persons exercising parental authority or to the persons or services to whom the child has been entrusted. They must be informed that no one may demand to see it and that any person called upon, by virtue of their position, to take cognisance of the information contained therein is bound by professional secrecy.

Lors de la déclaration de naissance, il est délivré gratuitement pour tout enfant un carnet de santé. Ce carnet est remis par l’officier d’état civil ; à défaut, il peut être demandé au service départemental de protection maternelle et infantile.

Un arrêté ministériel détermine le modèle et le mode d’utilisation de ce carnet où sont mentionnés obligatoirement les résultats des examens médicaux prévus aux articles L. 2132-2 et L. 2132-2-1 et où doivent être notées, au fur et à mesure, toutes les constatations importantes concernant la santé de l’enfant.

Le carnet est établi au nom de l’enfant. Il est remis aux parents ou aux personnes titulaires de l’exercice de l’autorité parentale ou aux personnes ou aux services à qui l’enfant a été confié. Ils doivent être informés que nul ne peut en exiger la communication et que toute personne appelée, de par sa fonction, à prendre connaissance des renseignements qui y sont inscrits est soumise au secret professionnel.
