Article L2141-11-1 of the French Public Health Code

The import and export of gametes or germ tissue derived from the human body are subject to authorisation issued by the Agence de la biomédecine. They are exclusively intended to enable the pursuit of a parental project through medically assisted procreation or the restoration of the applicant’s fertility or hormonal function, to the exclusion of any commercial purpose.

Only an establishment, a body, a health cooperation group or a laboratory holding the authorisation provided for in article L. 2142-1 to carry out a biological activity of medically assisted procreation may obtain the authorisation provided for in this article.

Only gametes and germ tissue collected and intended for use in accordance with the quality and safety standards in force, as well as the principles mentioned in articles L. 1244-3, L. 1244-4, L. 2141-2, L. 2141-3, L. 2141-11 and L. 2141-12 of the present Code and articles 16 to 16-8 of the Civil Code, may be the subject of an import or export authorisation.

Any breach of the requirements set out in the gametes or germ cell tissue import or export authorisation shall result in the suspension or withdrawal of this authorisation by the Agence de la biomédecine.

Article L2141-11-1

L’importation et l’exportation de gamètes ou de tissus germinaux issus du corps humain sont soumises à une autorisation délivrée par l’Agence de la biomédecine. Elles sont exclusivement destinées à permettre la poursuite d’un projet parental par la voie d’une assistance médicale à la procréation ou la restauration de la fertilité ou d’une fonction hormonale du demandeur, à l’exclusion de toute finalité commerciale.

Seul un établissement, un organisme, un groupement de coopération sanitaire ou un laboratoire titulaire de l’autorisation prévue à l’article L. 2142-1 pour exercer une activité biologique d’assistance médicale à la procréation peut obtenir l’autorisation prévue au présent article.

Seuls les gamètes et les tissus germinaux recueillis et destinés à être utilisés conformément aux normes de qualité et de sécurité en vigueur, ainsi qu’aux principes mentionnés aux articles L. 1244-3, L. 1244-4, L. 2141-2, L. 2141-3, L. 2141-11 et L. 2141-12 du présent code et aux articles 16 à 16-8 du code civil, peuvent faire l’objet d’une autorisation d’importation ou d’exportation.

Toute violation des prescriptions fixées par l’autorisation d’importation ou d’exportation de gamètes ou de tissus germinaux entraîne la suspension ou le retrait de cette autorisation par l’Agence de la biomédecine.
