The import and export of gametes or germ tissue derived from the human body are subject to authorisation issued by the Agence de la biomédecine. They are exclusively intended to enable the pursuit of a parental project through medically assisted procreation or the restoration of the applicant’s fertility or hormonal function, to the exclusion of any commercial purpose.
Only an establishment, a body, a health cooperation group or a laboratory holding the authorisation provided for in article L. 2142-1 to carry out a biological activity of medically assisted procreation may obtain the authorisation provided for in this article.
Only gametes and germ tissue collected and intended for use in accordance with the quality and safety standards in force, as well as the principles mentioned in articles L. 1244-3, L. 1244-4, L. 2141-2, L. 2141-3, L. 2141-11 and L. 2141-12 of the present Code and articles 16 to 16-8 of the Civil Code, may be the subject of an import or export authorisation.
Any breach of the requirements set out in the gametes or germ cell tissue import or export authorisation shall result in the suspension or withdrawal of this authorisation by the Agence de la biomédecine.
