An embryo may only be conceived in vitro within the framework and in accordance with the objectives of medically assisted procreation as defined in Article L. 2141-1.
Taking into account the state of medical techniques, the members of the couple or the unmarried woman may consent in writing to an attempt being made to fertilise a number of oocytes which may make it necessary to preserve embryos, with the intention of carrying out their parental project at a later date. In this case, the number is limited to what is strictly necessary for the success of the medically assisted procreation, taking into account the procedure used. Detailed information is given to the members of the couple or to the unmarried woman on the possibilities for the future of their preserved embryos which are no longer the subject of a parental project or in the event of the death of one of the members of the couple.
The two members of the couple or the unmarried woman may consent in writing to embryos that are not likely to be transferred or conserved being the subject of research under the conditions set out in article L. 2151-5.
A couple or an unmarried woman whose embryos have been conserved may not benefit from a new attempt at in vitro fertilisation before the embryos are transferred, unless these embryos are affected by a quality problem.
