Article L2195-4 of the French Public procurement code

If, during the performance of the contract, the contractor is placed in one of the cases of exclusion mentioned in articles L. 2141-1 to L. 2141-11, he shall inform the purchaser of this change in situation without delay.

The purchaser may then terminate the contract for this reason.

However, the purchaser may not terminate the contract for the sole reason that the economic operator is the subject of receivership proceedings pursuant to article L. 631-1 of the French Commercial Code, subject to the cases of automatic termination provided for in III of article L. 622-13 of the same code.

Lorsque le titulaire est, au cours de l’exécution du marché, placé dans l’un des cas d’exclusion mentionné aux articles L. 2141-1 à L. 2141-11, il informe sans délai l’acheteur de ce changement de situation.

L’acheteur peut alors résilier le marché pour ce motif.

Toutefois, l’acheteur ne peut prononcer la résiliation du marché au seul motif que l’opérateur économique fait l’objet d’une procédure de redressement judiciaire en application de l’article L. 631-1 du code de commerce, sous réserve des hypothèses de résiliation de plein droit prévues au III de l’article L. 622-13 du même code.
