The State may enter into a partnership contract on behalf of an unauthorised purchaser, provided that:
1° The ministry responsible has examined the project;
2° The operation is sustainable in terms of its impact on public finances and the financial situation of the public entity.

Article L2211-3

L’Etat peut conclure un marché de partenariat pour le compte d’un acheteur non autorisé, sous réserve que :
1° Le ministère de tutelle ait procédé à l’instruction du projet ;
2° L’opération soit soutenable au regard de ses conséquences sur les finances publiques et sur la situation financière de la personne publique.
