The mayor is responsible for traffic policing on trunk roads, departmental roads and all public or private roads open to public traffic within built-up areas, subject to the powers devolved to the State representative in the department for trunk roads. Outside built-up areas, the mayor also exercises traffic policing over roads in the communal public road domain and the inter-communal public road domain, subject to the powers devolved to the State representative in the département over trunk roads.
The conditions under which the mayor exercises traffic policing over trunk roads are set by decree in the Conseil d’Etat.
By way of derogation from the provisions of the two preceding paragraphs and those of articles L. 2213-2 and L. 2213-3, decrees may transfer traffic policing on certain sections of trunk roads to the remit of the State representative in the department.
