Article L2213-14 of the French General Code of Local Authorities

In order to ensure that the police measures prescribed by the laws and regulations are carried out, the operations of closing and sealing the coffin when cremation takes place are carried out:

– in communes with a State police system, under the responsibility of the chief of district, in the presence of a police officer delegated by him;

– in other communes, under the responsibility of the mayor, in the presence of the rural warden or a municipal police officer delegated by the mayor.

When the body is transported outside the commune of death or of deposit, the operations of closing and sealing the coffin are carried out under the responsibility of the funeral operator, in the presence of a member of the family. Failing this, they are carried out under the same conditions as in the second and third paragraphs.

The officials mentioned in the second and third paragraphs may attend, as necessary, any other operation following the death.

Afin d’assurer l’exécution des mesures de police prescrites par les lois et règlements, les opérations de fermeture et de scellement du cercueil lorsqu’il y a crémation s’effectuent :

– dans les communes dotées d’un régime de police d’Etat, sous la responsabilité du chef de circonscription, en présence d’un fonctionnaire de police délégué par ses soins ;

– dans les autres communes, sous la responsabilité du maire, en présence du garde champêtre ou d’un agent de police municipale délégué par le maire.

Lorsque le corps est transporté hors de la commune de décès ou de dépôt, les opérations de fermeture et de scellement du cercueil s’effectuent sous la responsabilité de l’opérateur funéraire, en présence d’un membre de la famille. A défaut, elles s’effectuent dans les mêmes conditions qu’aux deuxième et troisième alinéas.

Les fonctionnaires mentionnés aux deuxième et troisième alinéas peuvent assister, en tant que de besoin, à toute autre opération consécutive au décès.
