Article L2213-6 of the French Public procurement code

The contribution made by the State, local authorities or other public bodies to the financing of investments may take the form of a minority shareholding in the capital of the licensee when the latter is set up as a company dedicated to carrying out the project. In this case, the articles of association of this project company specify the distribution of risks between the shareholders and the measures taken to prevent conflicts of interest.

Le concours de l’Etat, des collectivités territoriales ou d’autres organismes publics au financement des investissements peut prendre la forme d’une participation minoritaire au capital du titulaire lorsque celui-ci est constitué en société dédiée à la réalisation du projet. Dans ce cas, les statuts de cette société de projet précisent la répartition des risques entre les actionnaires ainsi que les mesures prises afin de prévenir les conflits d’intérêt.
