Without prejudice to articles L. 2213-1 and L. 3221-4, the representative of the State in the department may, for reasons relating to public order or the safety of persons and property, regulate traffic and parking conditions on roads or portions of roads that he/she determines, located within a radius of five kilometres around the demarcated premises or enclosed land, to ensure the protection of establishments or facilities housing nuclear materials assigned to the means required to implement deterrence policy or nuclear materials the possession of which is subject to the authorisation mentioned in article L. 1333-2 of the Defence Code.
When, inside built-up areas, they concern national roads, departmental roads and all communication routes as well as, outside built-up areas, public communal and inter-communal roadways, the regulations mentioned in the first paragraph are enacted, except in emergencies, after consulting the mayor.
When, outside built-up areas, they concern roads in the public domain of the département, the regulations mentioned in the first paragraph are enacted, except in emergencies, after obtaining the opinion of the president of the département council.
In the absence of a response within fifteen days of receipt of the request for an opinion, the authorities consulted in application of the second and third paragraphs are deemed to have issued an opinion.
