Article L2232-8 of the French Labour Code

Branch agreements and professional agreements include, for the benefit of company employees taking part in negotiations, as well as in meetings of the joint bodies that they set up, provisions relating to the procedures for exercising the right to be absent, compensation for loss of wages or the maintenance of wages, as well as compensation for travel expenses.

For companies with a workforce below a threshold defined by decree of the Conseil d’Etat, the remuneration and social security contributions relating to the remuneration of company employees taking part in negotiations are paid by the joint fund mentioned in article L. 2135-9 on the basis of a lump sum set by order of the Minister responsible for labour.

Les conventions de branche et les accords professionnels comportent, en faveur des salariés d’entreprises participant aux négociations, de même qu’aux réunions des instances paritaires qu’ils instituent, des dispositions relatives aux modalités d’exercice du droit de s’absenter, à la compensation des pertes de salaires ou au maintien de ceux-ci, ainsi qu’à l’indemnisation des frais de déplacement.

Pour les entreprises dont l’effectif est inférieur à un seuil défini par décret en Conseil d’Etat, la rémunération ainsi que les cotisations et contributions sociales afférentes à la rémunération des salariés d’entreprise participant aux négociations sont prises en charge par le fonds paritaire mentionné à l’article L. 2135-9 sur la base d’un montant forfaitaire fixé par arrêté pris par le ministre chargé du travail.
