Article L2233-2 of the French Public procurement code

Where the partnership contract is entered into by the purchaser for the purpose of carrying out an operation that meets the needs of another legal entity governed by public or private law for the performance of its duties, or where the operation is carried out on the property of another legal entity governed by public or private law, the contractor may be authorised to use part of the property, subject to the agreement of the owner of the property.

Lorsque le marché de partenariat est conclu par l’acheteur pour la réalisation d’une opération répondant aux besoins d’une autre personne morale de droit public ou privé pour l’exercice de ses missions ou lorsque l’opération est réalisée sur le domaine d’une autre personne morale de droit public ou privé, le titulaire peut être autorisé à valoriser une partie du domaine, après accord du propriétaire du domaine.
