Article L2242-6 of the French Labour Code

Collective company agreements on actual salaries may only be filed with the administrative authority, under the conditions set out in article L. 2231-6, if accompanied by a report on the opening of negotiations on pay differentials between women and men, recording the respective proposals of the parties. The minutes certify that the employer has entered into negotiations seriously and fairly. The serious and fair commencement of negotiations implies that, in companies where one or more trade union sections of representative organisations have been set up, the employer has invited the trade union organisations that are representative in the company to the negotiations and has set the venue and timetable for the meetings. The employer must also have provided them with the necessary information to enable them to negotiate in full knowledge of the facts, and must have given a reasoned response to any proposals made by the trade union organisations.

Les accords collectifs d’entreprise sur les salaires effectifs ne peuvent être déposés auprès de l’autorité administrative, dans les conditions prévues à l’article L. 2231-6, qu’accompagnés d’un procès-verbal d’ouverture des négociations portant sur les écarts de rémunération entre les femmes et les hommes, consignant les propositions respectives des parties. Le procès-verbal atteste que l’employeur a engagé sérieusement et loyalement les négociations. L’engagement sérieux et loyal des négociations implique que, dans les entreprises où sont constituées une ou plusieurs sections syndicales d’organisations représentatives, l’employeur ait convoqué à la négociation les organisations syndicales représentatives dans l’entreprise et fixé le lieu et le calendrier des réunions. L’employeur doit également leur avoir communiqué les informations nécessaires pour leur permettre de négocier en toute connaissance de cause et avoir répondu de manière motivée aux éventuelles propositions des organisations syndicales.
