In order to be extended, the branch agreement or the professional or interprofessional agreement, their riders or annexes, must have been negotiated and concluded within the joint committee mentioned in article L. 2232-9.
This committee is made up of representatives of representative employers’ and employees’ trade unions in the field of application in question.
In order to be extended, the branch agreement or the professional or interprofessional agreement, their amendments or annexes, must not have been the subject, within a period of one month from the publication by the administrative authority of a notice of extension in the Official Journal of the French Republic, of the written and substantiated opposition of one or more professional employers’ organisations recognised as representative at the level in question, whose member companies employ more than 50% of all the employees of the companies belonging to the professional employers’ organisations recognised as representative at this level. This objection is notified and filed under the conditions provided for by articles L. 2231-5 and L. 2231-6.
