Article L2281-10 of the French Labour Code

In the absence of an agreement provided for in Article L. 2242-11 or in the event of non-compliance with its stipulations, the agreement dealing with the right of expression includes stipulations on :

1° The level, method of organisation, frequency and duration of meetings allowing employees to express themselves;

2° The digital tools available in the company, allowing employees to express themselves;

3° The measures intended to ensure, on the one hand, the freedom of expression of each individual and, on the other hand, the transmission to the employer of employees’ requests and proposals as well as of opinions expressed by employees in cases where they are consulted by the employer, without prejudice to the provisions relating to staff representative institutions;

4° The measures intended to enable the employees concerned, the representative trade union organisations and the social and economic committee to take cognisance of the requests, opinions and proposals emanating from the groups as well as the action taken on them;

5° The specific conditions for exercising the right to expression enjoyed by management staff with hierarchical responsibilities, in addition to their participation in the groups to which they are attached by virtue of these responsibilities.

A défaut d’accord prévu à l’article L. 2242-11 ou en cas de non-respect de ses stipulations, l’accord traitant du droit d’expression comporte des stipulations sur :


1° Le niveau, le mode d’organisation, la fréquence et la durée des réunions permettant l’expression des salariés ;


2° Les outils numériques disponibles dans l’entreprise, permettant l’expression des salariés ;


3° Les mesures destinées à assurer, d’une part, la liberté d’expression de chacun et, d’autre part, la transmission à l’employeur des demandes et propositions des salariés ainsi que celle des avis émis par les salariés dans les cas où ils sont consultés par l’employeur, sans préjudice des dispositions relatives aux institutions représentatives du personnel ;


4° Les mesures destinées à permettre aux salariés intéressés, aux organisations syndicales représentatives, au comité social et économique de prendre connaissance des demandes, avis et propositions émanant des groupes ainsi que des suites qui leur sont réservées ;


5° Les conditions spécifiques d’exercice du droit à l’expression dont bénéficie le personnel d’encadrement ayant des responsabilités hiérarchiques, outre leur participation dans les groupes auxquels ils sont rattachés du fait de ces responsabilités.
