Article L23-114-3 of the French Labour Code

The costs incurred by the operation of the committee, the attendance of its members at meetings and training, as well as the compensation of employee representatives, under the conditions defined in article L. 23-114-1, and the compensation of employer representatives are financed exclusively by the appropriations paid by the fund provided for in article L. 2135-9 in respect of its mission mentioned in 1° of article L. 2135-11.

The amount of the remuneration of an employee member of a committee, maintained by his employer in application of article L. 23-114-1, is reimbursed to the latter by the trade union organisation which appoints this employee, from the credits it receives from the fund provided for in article L. 2135-9.

In the event of non-reimbursement by the organisation, the employer may deduct the salary of the employee concerned.

The conditions of application of this article are defined by a decree of the Conseil d’Etat.

Article L23-114-3

Les frais occasionnés par le fonctionnement de la commission, la participation de ses membres aux réunions et la formation, ainsi que l’indemnisation des représentants salariés, dans les conditions définies à l’article L. 23-114-1, et l’indemnisation des représentants employeurs sont exclusivement financés par les crédits versés par le fonds prévu à l’article L. 2135-9 au titre de sa mission mentionnée au 1° de l’article L. 2135-11.

Le montant de la rémunération du salarié membre d’une commission, maintenu par son employeur en application de l’article L. 23-114-1, est remboursé à ce dernier par l’organisation syndicale qui désigne ce salarié, à partir des crédits qu’elle reçoit du fonds prévu à l’article L. 2135-9.

En cas de non-remboursement par l’organisation, l’employeur peut procéder à une retenue sur salaire du salarié concerné.

Les conditions d’application du présent article sont définies par un décret en Conseil d’Etat.
