For the purposes of Section 4 of Chapter II of this Title, an attempt to commit an offence under the provisions of this Title shall be deemed to have been made if, after it has begun to be committed, it was only suspended or failed to take effect as a result of circumstances beyond the control of the perpetrator. In particular, the offence of attempt is not constituted if the person renounces the attempt before being surprised by a third party not involved in the attempt.
