Article L230-5 of the French Sports Code

For the purposes of Section 4 of Chapter II of this Title, an attempt to commit an offence under the provisions of this Title shall be deemed to have been made if, after it has begun to be committed, it was only suspended or failed to take effect as a result of circumstances beyond the control of the perpetrator. In particular, the offence of attempt is not constituted if the person renounces the attempt before being surprised by a third party not involved in the attempt.

Pour l’application de la section 4 du chapitre II du présent titre, la tentative de commission d’une infraction aux dispositions de ce titre est constituée dès lors que, manifestée par un commencement d’exécution, elle n’a été suspendue ou n’a manqué son effet qu’en raison de circonstances indépendantes de la volonté de son auteur. L’infraction de tentative n’est notamment pas constituée si la personne renonce à la tentative avant d’être surprise par un tiers non impliqué dans celle-ci.
