Promoters of a specialised finance fund or securitisation mutual fund are liable to two years’ imprisonment and a fine of €750,000 if they invest in units of this fund without the approval of the fund management company or the approval of the Autorité des marchés financiers.

Article L231-7

Est puni d’un emprisonnement de deux ans et d’une amende de 750 000 euros le fait, pour les promoteurs d’un fonds de financement spécialisé ou un fonds commun de titrisation, de procéder au placement de parts de ce fonds sans agrément de la société de gestion du fonds ou sans visa de l’Autorité des marchés financiers.
