Article L2312-3 of the French Labour Code

When it is renewed, the social and economic committee exercises only the powers provided for in section 2 and ceases to exercise the powers provided for in section 3 if the number of employees has not reached fifty during the twelve months preceding the renewal of the body.

Lors de son renouvellement, le comité social et économique exerce exclusivement les attributions prévues à la section 2 et cesse d’exercer les attributions prévues à la section 3 lorsque l’effectif de cinquante salariés n’a pas été atteint pendant les douze mois précédant le renouvellement de l’instance.
