Section 1: General provisions

The powers of the social and economic committee in undertakings with fewer than fifty employees are defined in section 2 of this chapter. The responsibilities of the social and economic committee in undertakings with at least fifty employees are defined in section 3 of this chapter. The responsibilities of the social and economic committee are defined according to the number of employees in the company.

When, after the Social and Economic Committee has been set up, the number of employees in the undertaking reaches at least fifty for twelve consecutive months, the Committee exercises all the recurrent information and consultation powers defined in section 3 on expiry of a period of twelve months from the date on which the threshold of 50 employees has been reached for twelve consecutive months. When it is renewed, the social and economic committee exercises only the powers provided for in section 2 and ceases to exercise the powers provided for in section 3 if the number of employees has not reached fifty during the twelve months preceding the renewal of the body.

The provisions of this chapter do not preclude more favourable provisions relating to the powers of the social and economic committee resulting from collective labour agreements or practices.
