Article L2312-57 of the French Labour Code

In the absence of an agreement, one month after each election of the social and economic committee, the employer provides it with economic and financial documentation specifying:

1° The legal form of the company and its organisation;

2° The company’s economic prospects as they may be envisaged;

3° Where applicable, the company’s position within the group;

4° Taking into account the information available to the employer, the breakdown of capital between shareholders holding more than 10% of the capital and the position of the company in the branch of activity to which it belongs.

A défaut d’accord, un mois après chaque élection du comité social et économique, l’employeur lui communique une documentation économique et financière précisant :


1° La forme juridique de l’entreprise et son organisation ;


2° Les perspectives économiques de l’entreprise telles qu’elles peuvent être envisagées ;


3° Le cas échéant, la position de l’entreprise au sein du groupe ;


4° Compte tenu des informations dont dispose l’employeur, la répartition du capital entre les actionnaires détenant plus de 10 % du capital et la position de l’entreprise dans la branche d’activité à laquelle elle appartient.
