Article L2312-6 of the French Labour Code

The powers of the staff delegation to the social and economic committee are exercised for the benefit of employees, as well as :

1° Employees within the meaning of article L. 4111-5, in matters of health, safety and working conditions;

2° Employees of external undertakings who, in the performance of their activity, are not under the direct subordination of the user undertaking, for their individual and collective complaints concerning working conditions which are the responsibility of the head of the user establishment;

3° Temporary employees, for complaints concerning the application of the provisions of articles :

a) L. 1251-18 concerning remuneration ;

b) L. 1251-21 to L. 1251-23 concerning working conditions ;

c) L. 1251-24 concerning access to collective means of transport and collective facilities.

Article L2312-6

Les attributions de la délégation du personnel au comité social et économique s’exercent au profit des salariés, ainsi que :

1° Aux travailleurs au sens de l’article L. 4111-5, en matière de santé, sécurité et conditions de travail ;

2° Aux salariés d’entreprises extérieures qui, dans l’exercice de leur activité, ne se trouvent pas placés sous la subordination directe de l’entreprise utilisatrice, pour leurs réclamations individuelles et collectives, intéressant les conditions d’exécution du travail qui relèvent du chef d’établissement utilisateur ;

3° Aux salariés temporaires pour leurs réclamations intéressant l’application des dispositions des articles :

a) L. 1251-18 en matière de rémunération ;

b) L. 1251-21 à L. 1251-23 en matière de conditions de travail ;

c) L. 1251-24 en matière d’accès aux moyens de transport collectifs et aux installations collectives.
