Article L2315-80 of the French Labour Code

When the social and economic committee decides to call in an expert, the costs of the expert are paid for :

1° By the employer for the consultations provided for in articles L. 2315-88, L. 2315-91, in 3° of article L. 2315-92 and in 1° of article L. 2315-94 as well as in 3° of the same article L. 2315-94 in the absence of any indicator relating to professional equality provided for in article L. 2312-18 ;

2° By the committee, out of its operating budget, up to 20%, and by the employer, up to 80%, concerning the consultation provided for in article L. 2315-87 and ad hoc consultations other than those referred to in the second paragraph;

3° By the employer concerning the consultations mentioned in 2° of this article, when the operating budget of the social and economic committee is insufficient to cover the cost of the expertise and has not given rise to a transfer of annual surplus to the budget intended for social and cultural activities provided for in article L. 2312-84 during the previous three years.

Article L2315-80

Lorsque le comité social et économique décide du recours à l’expertise, les frais d’expertise sont pris en charge :

1° Par l’employeur concernant les consultations prévues par les articles L. 2315-88, L. 2315-91, au 3° de l’article L. 2315-92 et au 1° de l’article L. 2315-94 ainsi qu’au 3° du même article L. 2315-94 en l’absence de tout indicateur relatif à l’égalité professionnelle prévu à l’article L. 2312-18 ;

2° Par le comité, sur son budget de fonctionnement, à hauteur de 20 %, et par l’employeur, à hauteur de 80 %, concernant la consultation prévue à l’article L. 2315-87 et les consultations ponctuelles hors celles visées au deuxième alinéa ;

3° Par l’employeur concernant les consultations mentionnées au 2° du présent article, lorsque le budget de fonctionnement du comité social et économique est insuffisant pour couvrir le coût de l’expertise et n’a pas donné lieu à un transfert d’excédent annuel au budget destiné aux activités sociales et culturelles prévu à l’article L. 2312-84 au cours des trois années précédentes.
