Article L232-14-1 of the French Sports Code

Independently of the application of the provisions of Articles L. 232-13-1 and L. 232-14, the testing operations mentioned in Article L. 232-12 as well as those falling within the competence of the international sports organisations that are signatories to the World Anti-Doping Code may take place at an athlete’s home or place of accommodation between 11 p.m. and 6 a.m., while respecting the athlete’s privacy and intimacy, when the athlete belongs to one of the categories mentioned in Article L. 232-15, is a member of the Registered Testing Pool of an international sports organisation or a foreign National Anti-Doping Organisation, or is participating in an international sporting event.

When the test is carried out between 11 p.m. and 5 a.m., there must also be serious and corroborating suspicions that the athlete has contravened or will contravene the provisions of this chapter and there must be a risk that evidence will be lost.

Testing shall be carried out under conditions that ensure strict proportionality between the infringement of the athlete’s rights and the stakes involved in the fight against doping in terms of fair competition and the protection of the athlete’s health. Testing is limited to taking samples and collecting the athlete’s observations.

Article L232-14-1

Indépendamment de l’application des dispositions des articles L. 232-13-1 et L. 232-14, les opérations de contrôles mentionnées à l’article L. 232-12 ainsi que celles relevant de la compétence des organismes sportifs internationaux signataires du code mondial antidopage peuvent avoir lieu au domicile ou au lieu d’hébergement d’un sportif entre 23 heures et 6 heures, dans le respect de sa vie privée et de son intimité, lorsque le sportif appartient à l’une des catégories mentionnées à l’article L. 232-15, fait partie du groupe cible d’un organisme sportif international ou d’une organisation nationale antidopage étrangère ou participe à une manifestation sportive internationale.

Lorsque le contrôle est effectué entre 23 heures et 5 heures, il doit en outre exister, à l’encontre du sportif, des soupçons graves et concordants qu’il a contrevenu ou va contrevenir aux dispositions du présent chapitre et un risque de disparition de preuves.

Les opérations de contrôles sont effectuées dans des conditions garantissant une stricte proportionnalité entre les atteintes portées aux droits du sportif et les enjeux de la lutte contre le dopage en termes de loyauté des compétitions et de protection de sa santé. Elles se limitent au prélèvement d’échantillons et au recueil des observations du sportif.
