Independently of the application of the provisions of Articles L. 232-13-1 and L. 232-14, the testing operations mentioned in Article L. 232-12 as well as those falling within the competence of the international sports organisations that are signatories to the World Anti-Doping Code may take place at an athlete’s home or place of accommodation between 11 p.m. and 6 a.m., while respecting the athlete’s privacy and intimacy, when the athlete belongs to one of the categories mentioned in Article L. 232-15, is a member of the Registered Testing Pool of an international sports organisation or a foreign National Anti-Doping Organisation, or is participating in an international sporting event.
When the test is carried out between 11 p.m. and 5 a.m., there must also be serious and corroborating suspicions that the athlete has contravened or will contravene the provisions of this chapter and there must be a risk that evidence will be lost.
Testing shall be carried out under conditions that ensure strict proportionality between the infringement of the athlete’s rights and the stakes involved in the fight against doping in terms of fair competition and the protection of the athlete’s health. Testing is limited to taking samples and collecting the athlete’s observations.
