The testing operations mentioned in Article L. 232-14-1 may only be carried out if the athlete has given his consent to the director of the testing department of the French Anti-Doping Agency or to the competent international sports organisation.
The consent of the athlete may be sought by the director of the testing department of the French Anti-Doping Agency or the relevant international sports organisation. The athlete has one month from receipt of the request to give his or her consent. If no response is received within this period, the athlete is deemed to have refused consent.
The athlete’s consent is expressed in writing to the Director of the Testing Department of the French Anti-Doping Agency or to the relevant international sporting body. For athletes who are minors, the consent of the legal representative is required.
The organiser of an international sporting event may also request the athlete’s consent at the time of registration for the event, in accordance with the procedures laid down by decree in the Conseil d’Etat.
Testing may take place :
1° For the duration of the athlete’s inclusion in a Registered Testing Pool referred to in the first paragraph of article L. 232-14-1 or, failing that, for a period of three months, tacitly renewable once, from the date of receipt of consent where consent has been obtained under the conditions set out in the third paragraph of this article ;
2° For the duration of the sporting event when consent has been obtained under the conditions provided for in the fourth paragraph of this article.
