I.- Athletes in the target group designated for one year by the Agence française de lutte contre le dopage (French Anti-Doping Agency) are required to provide precise and up-to-date information on their whereabouts to enable the tests mentioned in article L. 232-5 to be carried out:
1° Athletes registered on the list of top-level athletes, elite athletes or national teams within the meaning of this code, or athletes who have been registered on one of these lists for all or part of the last three years;
2° Athletes who are licence-holders of approved federations and who exercise their activity on a professional basis or who have exercised it under these conditions for all or part of the last three years;
3° Sportsmen and sportswomen of French nationality exercising their activity abroad on a professional basis or having exercised it under these conditions for all or part of the last three years;
4° Athletes who have been subject to a disciplinary sanction on the basis of articles L. 232-9, L. 232-9-1, L. 232-9-2, L. 232-9-3, L. 232-10, L. 232-10-3, L. 232-10-4 or L. 232-17 during all or part of the last three years;
5° International-level sportsmen and women of French nationality or licensed members of approved federations and national-level sportsmen and women.
This information may be processed electronically by the Agency with a view to organising tests. It may be used for the purposes of investigations and disciplinary proceedings conducted by the Agency, as well as for the purposes of establishing the biological profile of athletes referred to in Article L. 232-12-1. This computerised processing of athletes’ whereabouts data, established in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, is authorised by decision of the Agency’s College.
II – Athletes mentioned in 1° to 5° of I who do not constitute the Registered Testing Pool shall provide the French Anti-Doping Agency, at its request, with information on their whereabouts to enable the tests mentioned in Article L. 232-5 to be carried out.
The conditions under which athletes must comply with the obligations set out in this article and breaches of these obligations are defined by decision of the French Anti-Doping Agency.
