Article L2321-9 of the French Labour Code

The validity of a company or establishment agreement concluded by the works council is subject to its signature by a majority of the elected full members of the works council or by one or more full members who received more than 50% of the votes cast in the last professional elections. To determine the latter threshold, the votes received in the first round of elections are taken into account for those elected in the first round of elections, and those received in the second round of elections are taken into account for those elected in the second round of elections.

La validité d’une convention ou d’un accord d’entreprise ou d’établissement conclu par le conseil d’entreprise est subordonnée à sa signature par la majorité des membres titulaires élus du conseil ou par un ou plusieurs membres titulaires ayant recueilli plus de 50 % des suffrages exprimés lors des dernières élections professionnelles. Pour l’appréciation de ce dernier seuil, il est tenu compte des suffrages recueillis lors du premier tour des élections pour les élus au premier tour de scrutin, et de ceux recueillis lors du second tour pour les élus au second tour de scrutin.
