Article L2326-2 of the French Public Health Code

Opening or running one of the establishments mentioned in article L. 2322-1 without authorisation or failing to comply with the conditions of the authorisation is punishable by a fine of 4,500 euros.

The establishment may also be closed.

A repeat offence within three years is punishable by two years’ imprisonment and a fine of 9,000 euros, without prejudice to the stiffer penalties incurred in particular for felonies and misdemeanours under article L. 2221-1 of this Code and articles 223-3, 223-4, 223-10 to 223-12, 227-1, 227-2 and 227-13 of the Criminal Code.

Le fait d’ouvrir ou de diriger sans autorisation un des établissements mentionnés à l’article L. 2322-1 ou de négliger de se conformer aux conditions de l’autorisation est puni de 4500 euros d’amende.

L’établissement peut, en outre, être fermé.

La récidive dans les trois ans, est punie de deux ans d’emprisonnement et de 9000 euros d’amende sans préjudice des peines plus fortes encourues notamment du fait des crimes et délits par l’article L. 2221-1 du présent code et les articles 223-3, 223-4, 223-10 à 223-12, 227-1, 227-2 et 227-13 du code pénal.
