Article L2332-1 of the French Public procurement code

The purchaser may not communicate, subject to rights acquired by contract, confidential information of which he has become aware during the award procedure, such as information the disclosure of which would infringe business secrecy or information the disclosure of which could harm fair competition between economic operators, in particular the total amount or detailed price of tenders during the consultation.
However, the purchaser may ask economic operators to consent to the disclosure of certain confidential information which they have supplied and which is specifically designated.
The purchaser may impose on economic operators requirements designed to protect the confidentiality of the information which they communicate in the context of the procedure for awarding a contract.

L’acheteur ne peut communiquer, sous réserve des droits acquis par contrat, les informations confidentielles dont il a eu connaissance lors de la procédure de passation, telles que celles dont la divulgation violerait le secret des affaires ou celles dont la communication pourrait nuire à une concurrence loyale entre les opérateurs économiques, notamment du montant total ou du prix détaillé des offres en cours de consultation.
Toutefois, l’acheteur peut demander aux opérateurs économiques de consentir à ce que certaines informations confidentielles qu’ils ont fournies, précisément désignées, puissent être divulguées.
L’acheteur peut imposer aux opérateurs économiques des exigences visant à protéger la confidentialité des informations qu’ils communiquent dans le cadre de la procédure de passation d’un marché.
