For the purposes of the first paragraph of Article L. 2112-3, the life cycle of equipment is understood to mean all the successive states it may undergo, including research and development, industrial development, production, repair, modernisation, modification, maintenance, logistics, training, testing, withdrawal, dismantling and disposal.
To organise its purchasing, the purchaser may: 1° Pool its requirements with other purchasers, under the conditions set out in the section 1 ; 2° Allocate the services covered by the contract, under the conditions set out in section 2 . A central purchasing body is a buyer or a public body in the European Union whose purpose is to carry out one of the following centralised purchasing activities:1° The acquisition of defence or security supplies or services intended for buyers;2° The award of defence or security contracts intended for buyers.
A purchaser who has recourse to a central purchasing body shall be deemed to have complied with its advertising and competitive tendering obligations, provided that the central purchasing body complies with the provisions of this Book or with the objectives of Directive 2009/81/EC of the European Parliament and of the Council of 13 July 2009 on the coordination of procedures for the award of certain works contracts, by contracting authorities/entities…
The provisions of articles L. 2113-6 to L. 2113-8 relating to grouped orders and the provisions of article L. 2113-9 relating to transnational joint entities apply.
Defence or security contracts may be awarded in separate lots. The purchaser determines the number, size and subject of the lots.It may limit the number of lots for which a single economic operator may submit a tender or the number of lots that may be awarded to a single economic operator.
