Article L2393-1 of the French Public procurement code

Under the conditions laid down in this chapter, the holder of a defence or security contract may, under its responsibility, entrust another economic operator, called a subcontractor, with the performance of part of its contract, including a supply contract, without this constituting a transfer of the contract.
A subcontractor is a subcontractor within the meaning of Article L. 2193-2 or an economic operator with whom the contractor enters into a contract without the characteristics of a works contract with a view to the performance of part of its contract.
A contract does not have the characteristics of a works contract, within the meaning of the previous paragraph, when its purpose is the supply of products or the provision of services which are not specially produced to meet the needs of the purchaser.

Dans les conditions fixées par le présent chapitre, le titulaire d’un marché de défense ou de sécurité peut, sous sa responsabilité, confier à un autre opérateur économique, dénommé sous-contractant, l’exécution d’une partie de son marché, y compris un marché de fournitures, sans que cela consiste en une cession du marché.
Un sous-contractant est un sous-traitant au sens de l’article L. 2193-2 ou un opérateur économique avec lequel le titulaire conclut en vue de la réalisation d’une partie de son marché un contrat dépourvu des caractéristiques du contrat d’entreprise.
Un contrat est dépourvu des caractéristiques du contrat d’entreprise, au sens de l’alinéa précédent, lorsqu’il a pour objet la fourniture de produits ou la prestation de services qui ne sont pas réalisés spécialement pour répondre aux besoins de l’acheteur.
