Each commune in the overseas departments receives an allocation under the equalisation grant mentioned in III of article L. 2334-23-1 calculated on the basis of its population, multiplied by a synthetic index composed of:
1° The ratio between the per capita financial potential of all the communes in the overseas departments and the per capita financial potential of the commune. The financial potential taken into account includes the amounts collected in respect of dock dues recorded in the management account relating to the penultimate financial year;
2° The ratio between the average per capita income of all the municipalities in the overseas departments and the per capita income of the municipality;
3° The ratio between the proportion of the number of beneficiaries of the active solidarity income mentioned in article L. 262-1 du code de l’action sociale et des familles in the population of the municipality, and this same proportion recorded for all the municipalities in the overseas departments;
4° The ratio between the proportion of total recipients of housing benefit, including their spouse and dependants usually living in their household, in the total number of dwellings in the municipality and this same proportion recorded for all the municipalities in the overseas departments ;
5° The ratio between the proportion of children aged between three and sixteen domiciled in the municipality in the population of the municipality and this same proportion recorded for all the municipalities in the overseas departments.
The synthetic index is obtained by adding together the ratios defined in 1° to 5° of this article, by dividing the ratio mentioned in 1° by two.
The synthetic index is multiplied by 1.5 for municipalities with more than 10,000 inhabitants that are department or arrondissement chief towns.
From 2020, the sum of the per capita allocations received by a commune in an overseas department under the development allowance for overseas communes and the equalisation allowance may not be less than the per capita amount received in 2019 under the development allowance for overseas communes. Where applicable, the adjustment is made within the equalisation grant.
The terms and conditions for the application of this article are specified by decree in the Conseil d’Etat.
