Article L2341-9 of the French Labour Code

The information and consultation of the European Works Council are coordinated with those of the other staff representative bodies mentioned in this book and those set up in application of the law of the Member State in whose territory the undertaking or establishment is located, according to their respective competences and areas of intervention.

When the European Works Council is set up in the absence of an agreement or when the agreement does not provide for the coordination arrangements referred to in 4° of article L. 2342-9 and in the event that decisions likely to lead to significant changes in the organisation of work or in employment contracts are envisaged, the information and consultation process is carried out both within the European Works Council and within the national institutions representing the personnel.

L’information et la consultation du comité d’entreprise européen sont articulées avec celles des autres institutions représentatives du personnel mentionnées au présent livre et celles mises en place en application du droit de l’Etat membre sur le territoire duquel est implanté l’entreprise ou l’établissement, en fonction de leurs compétences et domaines d’intervention respectifs.

Lorsque le comité d’entreprise européen est constitué en l’absence d’accord ou lorsque l’accord ne prévoit pas les modalités d’articulation visées au 4° de l’article L. 2342-9 et dans le cas où des décisions susceptibles d’entraîner des modifications importantes dans l’organisation du travail ou dans les contrats de travail sont envisagées, le processus d’information et de consultation est mené tant au sein du comité d’entreprise européen que des institutions nationales représentatives du personnel.
