Article L2342-2 of the French Public procurement code

The purchaser may refuse to accept an economic operator who, having regard in particular to the geographical location outside the territory of the European Union of the tools, materials, technical equipment, personnel, know-how and sources of supply at his disposal, does not have the technical capability to perform the contract, to cope with any increase in requirements as a result of a crisis or to ensure the maintenance, modernisation or adaptation of the supplies covered by the contract.

L’acheteur peut ne pas accepter un opérateur économique qui, au regard notamment de l’implantation géographique hors du territoire de l’Union européenne de l’outillage, du matériel, de l’équipement technique, du personnel, du savoir-faire et des sources d’approvisionnement dont il dispose, ne présente pas les capacités techniques pour exécuter le marché, pour faire face à d’éventuelles augmentations des besoins par suite d’une crise ou pour assurer la maintenance, la modernisation ou les adaptations des fournitures faisant l’objet du marché.
