Article L2373-4 of the French Labour Code

Where the participation of employees within the companies participating in the cross-border operation concerns at least one third of the total number of employees employed by these companies, or where this threshold is not reached and the special negotiating body so decides, the form of employee participation in the administrative or supervisory body of the company resulting from the operation shall be determined after examination of the different national systems existing within each of the participating companies prior to the registration of this company.

Lorsque la participation des salariés au sein des sociétés participant à l’opération transfrontalière concerne au moins un tiers du nombre total des salariés employés par ces sociétés, ou lorsque ce seuil n’est pas atteint et que le groupe spécial de négociation en décide ainsi, la forme de participation des salariés à l’organe d’administration ou de surveillance de la société issue de l’opération est déterminée après examen des différents systèmes nationaux existant au sein de chacune des sociétés participantes avant l’immatriculation de cette société.
