Under the conditions laid down in this chapter, the holder of a defence or security contract may, under its responsibility, entrust another economic operator, called a subcontractor, with the performance of part of its contract, including a supply contract, without this constituting a transfer of the contract.
A subcontractor is a subcontractor within the meaning of Article L. 2193-2 or an economic operator with whom the contractor enters into a contract without the characteristics of a works contract with a view to the performance of part of its contract.
A contract does not have the characteristics of a works contract, within the meaning of the previous paragraph, when its purpose is the supply of products or the provision of services which are not specially produced to meet the needs of the purchaser.
