The transfer to the municipality of all or part of the property, rights and obligations of a section may be pronounced by the State representative in the department, at the request of the municipal council in order to implement an objective of general interest.
When it is set up, the syndicate commission is consulted on the municipal council’s deliberation and has a period of two months from its referral to give an opinion to the municipal council. Where the syndicate committee has not been set up, the municipal council’s deliberation is published in a medium authorised to receive legal notices distributed in the department and posted in the town hall for a period of two months during which the members of the section may submit their observations.
Where the transfer involves property for agricultural or pastoral use, the chamber of agriculture is informed of the request and may issue an opinion to the municipal council on the intended use by the municipality of the property to be transferred.
Within two months of the transfer order, the State representative in the département brings this transfer to the attention of the public and notifies the transfer order to the syndicate commission when it has been set up, as well as to the mayor of the commune for posting in the town hall for a period of two months.
The members of the section may claim compensation under the conditions set out in article L. 2411-11.
