Article L2411-13 of the French General Code of Local Authorities

At the end of a period of five years from the merger pronounced by the decree provided for in article L. 2113-5 as it read prior to Law no. 2010-1563 of 16 December 2010 on the reform of territorial communities or the creation of a new commune ordered by the decree provided for in Article L. 2113-3, the assets and rights of commune sections created following the merger of two or more communes or the attachment of part of the territory of one commune to another commune may be transferred in whole or in part, as necessary, to the commune by order of the State representative in the département issued after a public enquiry carried out in accordance with the code of relations between the public and the administration at the request of the municipal council.

Article L2411-13

Au terme d’un délai de cinq ans à compter de la fusion prononcée par l’arrêté prévu à l’article L. 2113-5 dans sa rédaction antérieure à la loi n° 2010-1563 du 16 décembre 2010 de réforme des collectivités territoriales ou de la création d’une commune nouvelle prononcée par l’arrêté prévu à l’article L. 2113-3, les biens et droits des sections de commune créées consécutivement à la fusion de deux ou plusieurs communes ou au rattachement d’une partie du territoire d’une commune à une autre commune peuvent être transférés en tout ou partie, en tant que de besoin, à la commune par arrêté du représentant de l’Etat dans le département pris après enquête publique réalisée conformément au code des relations entre le public et l’administration à la demande du conseil municipal.
