Article L2411-17 of the French Labour Code

The dismissal of an employee representative on the board of directors or supervisory board of public-sector companies, limited companies and partnerships limited by shares may only take place with the authorisation of the labour inspector.

This authorisation is also required for :

1° Former employee representatives during the first six months following the end of their term of office;

2° Candidates and former candidates for election as employee representatives during the three months following the submission of candidacies.

Le licenciement d’un représentant des salariés au conseil d’administration ou de surveillance des entreprises du secteur public, des sociétés anonymes et des sociétés en commandite par actions ne peut intervenir qu’après autorisation de l’inspecteur du travail.

Cette autorisation est également requise pour :

1° L’ancien représentant des salariés pendant les six premiers mois suivant la cessation de son mandat ;

2° Le candidat et l’ancien candidat à l’élection comme représentant des salariés pendant les trois mois suivant le dépôt des candidatures.
