I. – Subject to the provisions of article L. 2411-15, the syndicate commission deliberates on the following matters:
<1° Contracts entered into with the commune of attachment or another section of that commune;
2° Sale, exchange and lease for nine years or more of property of the section other than the sale provided for in 1° of II;
3° Change of use of such property;
4° Settlement and legal actions;
5° Acceptance of gifts;
6° Division of undivided property;
7° Establishment of a union of sections;
8° Appointment of delegates representing the commune section.
The acts necessary for the execution of these deliberations are passed by the president of the syndicate commission.
II. – The municipal council is competent to deliberate on the following matters:
1° Sale of property of the section with the objective of carrying out an investment necessary for the performance of a public service, the establishment of a subdivision or the performance of an operation of public interest;
2° Lease of property of the section granted for a period of less than nine years;
3° Membership of the section in a syndicate association or other structure for land consolidation or forest management.
When the syndicate commission is set up, it is consulted on the draft deliberation of the town council and has a period of two months to issue an opinion. In the absence of a deliberation by the commission within this period, the opinion is deemed to be favourable.
The acts necessary for the execution of these deliberations are taken by the mayor.
