Article L2411-7 of the French General Code of Local Authorities

The syndicate commission is called upon to give its opinion on the arrangements for the enjoyment of the section’s property, the fruits of which are collected in kind, as determined by the town council.

It is consulted on the development of marshland and uncultivated or obviously under-exploited land belonging to the section under the conditions provided for by the articles L. 125-1 to L. 125-7 of the Rural and Maritime Fishing Code.

It is called upon to give its opinion, in a general manner, on all matters where its consultation is provided for by the laws and regulations in force.

In the event of disagreement between the town council and the syndicate commission or if the latter has not given its opinion on the matters referred to in the first paragraph of this article within two months of the matter being referred to it, a decision shall be taken by reasoned order of the State representative in the department.

La commission syndicale est appelée à donner son avis sur les modalités de jouissance des biens de la section dont les fruits sont perçus en nature déterminées par le conseil municipal.

Elle est consultée sur la mise en valeur des marais et terres incultes ou manifestement sous-exploitées appartenant à la section dans les conditions prévues par les articles L. 125-1 à L. 125-7 du code rural et de la pêche maritime.

Elle est appelée à donner son avis, d’une manière générale, sur toutes les matières où sa consultation est prévue par les lois et règlements en vigueur.

En cas de désaccord entre le conseil municipal et la commission syndicale ou si celle-ci ne s’est pas prononcée sur les objets visés au premier alinéa du présent article dans un délai de deux mois à compter de sa saisine, il est statué par arrêté motivé du représentant de l’Etat dans le département.
