Article L2422-6 of the French Public procurement code

The purpose of a project management contract is to entrust the agent with the exercise of some or all of the powers referred to in Article L. 2421-1, of all or some of the following:
1° Defining the administrative and technical conditions under which the work will be designed and executed;
2° Preparing, awarding and signing, after approval of the successful tenderer, the project management contract and monitoring its execution;
3° Approving the preliminary design and project studies of the project manager;
4° Preparing, awarding and signing public works contracts, after approving the choice of contractor, and monitoring their performance;
5° Paying the project manager’s remuneration and public works contracts;
6° Taking delivery of the work.

Le contrat de mandat de maîtrise d’ouvrage a pour objet de confier au mandataire l’exercice, parmi les attributions mentionnées à l’article L. 2421-1, de tout ou partie des attributions suivantes :
1° La définition des conditions administratives et techniques selon lesquelles l’ouvrage sera étudié et exécuté ;
2° La préparation, la passation, la signature, après approbation du choix de l’attributaire, du marché public de maîtrise d’œuvre ainsi que le suivi de son exécution ;
3° L’approbation des études d’avant-projet et des études de projet du maître d’œuvre ;
4° La préparation, la passation, la signature, après approbation du choix des attributaires, des marchés publics de travaux, ainsi que le suivi de leur exécution ;
5° Le versement de la rémunération du maître d’œuvre et le paiement des marchés publics de travaux ;
6° La réception de l’ouvrage.
