The buyers defined in chapitre Ier who, planning the construction of a work meeting the characteristics mentioned in chapter II, envisage the award of public contracts for this purpose, are subject in their capacity as project owners to the provisions of this book.
Project owners are principally responsible for the project. They may not delegate this function of general interest, defined in Title II, subject to the provisions of this book relating to the mandate and transfer of project ownership, the provisions of Book II relating to partnership contracts, article L. 121-5 of the Highway Code and articles L. 115-2 and L. 115-3 of the same code. The provisions of this book are applicable to new construction or refurbishment operations involving a facility defined in article L. 1111-2 and covered by a public contract, as well as to industrial equipment intended for the operation of these facilities.

The programme drawn up by the project owner includes the following elements relating to the construction and use of the project:1° The objectives to be achieved by the project;2° The needs to be met by the project;3° The constraints and requirements in terms of social, town-planning, architectural, functional, technical and economic quality, integration into the landscape and environmental protection.
The project owner draws up the programme and sets the estimated financial budget for the project before the project manager begins preliminary design studies.The project owner may specify the programme and financial budget before the project manager begins design studies.
The development of the programme and the setting of the provisional financial envelope may continue during the preliminary design studies for:1° Refurbishment projects;2° New construction projects involving complex works, provided that the project owner has specified this in the tender documents for the public works contract.
The consequences of changes to the programme and the estimated financial envelope are taken into account by a contractual amendment to the public works contract, in accordance with the provisions of Chapter IV of Title IX of Book I.
The project owner may, under the conditions set out in this chapter, use the services of third parties in the following ways:1° Assistance to the project owner;2° Project management;3° Project management mandate;4° Transfer of project management.
