Article L2432-1 of the French Public procurement code

The public contract for private project management provides for lump-sum remuneration of the contractor, taking into account the scope of the assignment, its degree of complexity and the estimated cost of the works.
The procedures for determining the remuneration of the project manager and the consequences of the latter’s failure to comply with the commitments entered into with regard to the estimated cost of the works, with a distinction being made according to the contracting authority, the nature of the operation and the work concerned, are specified by regulation.

Article L2432-1

Le marché public de maîtrise d’œuvre privée prévoit une rémunération forfaitaire du titulaire qui tient compte de l’étendue de la mission, de son degré de complexité et du coût prévisionnel des travaux.
Les modalités de fixation de la rémunération du maître d’œuvre ainsi que les conséquences de la méconnaissance par celui-ci des engagements souscrits sur un coût prévisionnel des travaux, en distinguant selon le maître d’ouvrage, la nature de l’opération et l’ouvrage concerné, sont précisées par voie réglementaire.
